TERMS AND CONDITIONS OF USE - VIETNAM.TRAVEL

By accessing, browsing, or using this website (vietnam.travel), associated subdomains, mobile applications, and digital services (collectively, the "Platform"), you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please discontinue using the Platform immediately.

1. INTELLECTUAL PROPERTY RIGHTS

A. Ownership

All content, materials, and digital assets available on this Platform—including but not limited to text, photographs, graphic design, logos, trademarks, video clips, audio, software code, interactive destination maps, and data compilations—are the exclusive intellectual property of the Vietnam National Authority of Tourism (VNAT) or its licensed partners, protected under the Intellectual Property Law of Vietnam and international treaties.

B. Permitted & Restricted Use

  • Non-Commercial Use: You are granted a limited, non-exclusive, non-transferable, and revocable license to access, view, download, and print portal content solely for personal, non-commercial travel planning purposes.

  • Prohibited Reproduction: Any reproduction, modification, distribution, republication, framing, scraping, commercial exploitation, or unauthorized mirroring of Platform content without prior explicit written consent from the Platform Management Team is strictly prohibited.

2. PORTAL SERVICES & INFORMATION DISCLAIMER

A. Tourism Information & Accuracy

Vietnam.travel provides travel guides, destination insights, entry requirement outlines, and interactive tools for informational purposes. While we exercise due diligence to ensure all information (such as visa policies, border gate listings, and travel advisories) is accurate and up to date, travel regulations and operating conditions may change rapidly.

  • Users are strongly advised to verify critical travel details (e.g., e-Visa policies, border requirements, flight schedules) with official government channels or respective service providers prior to departure.

B. Third-Party Links & External Services

The Platform may contain links to third-party websites, airlines, tour operators, booking engines, or official government portals (e.g., evisa.gov.vn).

  • Vietnam.travel does not operate, control, or endorse third-party platforms and assumes no legal responsibility for their content, booking transactions, or privacy practices. Your interactions with third-party sites are governed solely by their respective terms and policies.

3. USER CONDUCT & OBLIGATIONS

When utilizing the Platform, you agree NOT to:

  1. System Interference: Use any automated tools (robots, spiders, crawlers, or scraping scripts) to extract data or disrupt the infrastructure of the Platform.

  2. Cybersecurity Infringements: Upload or transmit viruses, malware, corrupted files, or execute denial-of-service (DoS) attacks targeting the Platform, violating the Law on Cybersecurity of Vietnam.

  3. Misrepresentation: Provide false identity information, impersonate any person or organization, or submit fraudulent inquiries or feedback.

  4. Unauthorized Commercial Activity: Use the Platform’s communication channels, forums, or feedback mechanisms to distribute unsolicited commercial communications (spam), promotional materials, or illegal content.

4. PERSONAL DATA PROTECTION & PRIVACY

Your privacy is paramount. All personal data collected through your use of the Platform is processed in strict compliance with the Law on Personal Data Protection 2025 (Law No. 91/2025/QH15), Decree No. 356/2025/NĐ-CP, and applicable international standards (GDPR/CCPA).

  • Privacy Policy Incorporation: By using the Platform, you consent to the collection, processing, and transfer of your personal data as detailed in our Privacy Policy.

  • Consent Management: You retain full rights to manage, modify, or withdraw your data consent and request data erasure in accordance with statutory procedures.

5. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

  1. No Warranty: The Platform and all its content are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory.

Indirect Damages: Vietnam.travel, its operators, or affiliated government entities shall not be liable for any direct, indirect, incidental, consequential, or punitive damages (including loss of data, missed travel itineraries, booking cancellations, or financial losses) arising out of your access to, use of, or inability to use the Platform.

  3. Service Interruptions: We do not warrant that the Platform will operate uninterrupted, error-free, or completely free of server downtime or technical glitches.

6. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Vietnam.travel, its portal operators, officers, employees, and legal representatives from and against any claims, liabilities, damages, costs, and legal fees arising from:

  • Your violation of these Terms or applicable laws;

  • Your unauthorized use or misuse of Platform content;

  • Any infringement by you of third-party intellectual property or privacy rights.

7. MODIFICATIONS TO TERMS & PLATFORM

  • Right to Amend: We reserve the right to revise, update, or modify these Terms at any time without prior notice. Amended Terms become effective immediately upon being published on this page.

  • Continued Use: Your continued access or use of the Platform following any modifications constitutes your formal acceptance of the updated Terms.

8. GOVERNING LAW & DISPUTE RESOLUTION

  • Governing Law: These Terms shall be governed by, construed, and enforced in accordance with the laws of the Socialist Republic of Vietnam.

  • Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the Platform shall first be resolved through good-faith negotiations. If unresolved, the dispute shall be submitted to the competent Courts of Hanoi, Vietnam for final adjudication.
